This is a full time, permanent post although part- time job share may be considered.

Additional information

The Solicitor is responsible for providing a wide range of legal services, as part of the Legal and Democratic Services Section, to the Council and its Directorates.

The team deals with a diverse and complex range of work reflecting the variety of issues for which the Council has responsibility, ensuring that at all times the council operates in accordance with the law in an increasing complex statutory and regulatory environment. The majority of staff time is spent supporting the work of internal clients, namely the various service departments on core matters but staff also routinely provide advice and guidance relative to service policies and procedures, governance issues and also act as legal advisers relative to business transacted at the Council’s various Committees and sub-committees. The team also provides representation of the Council in court and tribunals etc and a service to external clients relative to liquor, civic government and other licensing.

This Solicitor post will normally focus on the provision of Regulatory Services including Licensing (as adviser to the Licensing Committee and Depute Clerk to the Licensing Board) and Planning (as adviser to the Planning and Regulatory Services Committee, Local Review Body and Planning Service). However the Solicitor may be required to assist in any of the following areas:

  • Provision of the Litigation and Social Care Service including representation of the Council in Court and Tribunals etc.
  • Provision of the Property and Contracts Service.
  • Provision of legal advice to Committees, Members and Officers of the Council both written and verbal.
  • Co-operation with other solicitors and assisting in the provision of support and training for Paralegals.
  • Undertaking such other duties as may from time to time be allocated.

The range of services may include the following:

  • To provide advice and assistance to maintain high standards of decision-making and good governance within the Council, including attending at meetings of the Council and its committees.
  • To develop areas of specialist expertise, in specific local authority functions as directed by the manager, with the associated advisory and drafting work in these specialist areas;
  • To represent the Council at Court, Arbitration, Tribunal, Enquiries and Hearings regarding e.g. actions for payment, reparation, interdicts, recovery of heritable property, actions relating to protection of children and vulnerable adults, staffing appeals and industrial tribunals. In this connection there would be a requirement to deal professionally with those who need to be treated sensitively;
  • To carry out all legal work required in connection with the purchase, sale and lease of land/buildings, including advising directorates, concluding missives and recording title, and to be accountable for the incurring of expenditure on settlement of transactions;
  • To carry out all legal work required in connection with the drawing up of contracts and agreements in relation to all Council functions;

Essential

  • Scottish LLB law degree or equivalent Scottish qualification
  • Diploma in legal Practice
  • Current Practising Certificate (unrestricted) from the law Society of Scotland
  • Continual professional development as required by law Society of Scotland.

The successful applicant will be responsible for payment of their own Practising Certificate and contribution to the Guarantee Fund.
