With a workforce of more than 22,000 Police Officers and Staff and an annual budget of £1.1 Billion Police Scotland is the second largest Police Service in the UK and serves a population of over 5 Million people, in cities, towns and across the rural and island communities. The Authority is also the legal employer of all Police Staff, and has significant legal responsibilities for Police Officers, including their terms and conditions of service.
To lead on the provision of legal advice to the Authority on a range of areas including employment law, complaints and conduct, health and safety, and litigation at all levels, taking into account legislation and policy requirements. To appear, and instruct external counsel to appear, on behalf of the SPA at employment tribunals and courts throughout the UK, including the Sheriff Courts and the Court of Session.
Assist the Head of Legal and Compliance in the provision of general legal advice and assistance to the Scottish Police Authority, including its Board and Committees. To advise the SPA Members and Officers including HR and Remuneration Committee and Senior Management on a range of employment law, HR, industrial relations and equalities issues. To advise on employment law and other law regarding advice, issues and implications arising from the decisions and actions of the SPA. Acting as legal adviser to SPA's HR and Remuneration Appeals subcommittee in internal appeals by police staff. OFFICIAL OFFICIAL. Represent the SPA at the Employment Tribunal and the Employment Appeal Tribunal in claims against the SPA and carrying out all associated work from inception of proceedings to conclusion in order to protect the SPA's interests. To negotiate termination packages and associated drafting of settlement agreements on behalf of the SPA in order to protect the SPA's interests. To develop and input into training for colleagues on a range of HR and employment law matters. To provide strategic, ad hoc and case specific legal advice to Complaints and Conduct Committee and to Complaints Department on a range of key legal matter. To advise the Complaints and Conduct Committee on misconduct issues in relation to senior police officers and complaints by members of the public. To advice the Complaints and Conduct Committee and representing the SPA’s interests in conduct proceedings in respect of senior police officers in order to protect the SPA's interests. To advise Complaints and Conduct Committee on relevant police regulations, changes to regulations, relevant case law and legislation in order to protect the SPA's interests. Attending meetings of Complaints and Conduct Committee providing strategic, legal and tactical advice. Providing, developing and input into training for colleagues on a range of complaints and conduct related matters. Providing input to consultations or discussions with the Scottish Government or other stakeholders in relation to changes to regulations that relates to SPA employees and/or police officers' terms and conditions. Representing the SPA and Forensic Services in civil and criminal litigation in courts and tribunals throughout the UK and carrying out all associated work from inception of proceedings to conclusion in order to protect the SPA's interests. Instructing external counsel as appropriate to appear on behalf of the SPA in courts and tribunals. Advising Forensic Services business area on legal issues, including interpretation of legislation, policies, case law, powers, functions and OFFICIAL OFFICIAL relationships with other parties including independent forensic scientists, Police Service of Scotland, COPFS and others. Providing strategic and legal advice to the SPA, including Board Members and Senior Management on health and safety, information management and non-contractual obligations and advising on measures to be taken, proactive and reactive, in order to protect the SPA's interests. Advising SPA in relation to legal issues in respect of confidentiality, disclosure and data protection. Drafting, reviewing and negotiating contracts and other legal documentation required in support of organisational objectives. Advising in relation to policies and standard operating procedures. Providing advice to business areas in relation to new contractual arrangements and in the interpretation of existing contractual arrangements. Identifying and mitigating legal risk within the SPA and providing commercial legal advice as required. Providing input into strategy and policy relating to staff issues, including in relation to business change. Managing the outsourcing of legal matters to external legal suppliers to ensure quality, cost efficiency and appropriate timescales for matter progression. Will be responsible for assessing and self-managing risk within all aspects of the role.
